OutThere is operated by Hostelworld.com Limited, a company registered in Ireland under company number 337103, with registered address at 8 Harcourt Street, Dublin 2, D02 AF58, Ireland (“Hostelworld”, "we", "us", or "our"). By creating an account, accessing, or using the OutThere mobile application or associated services (collectively, the "Service"), you enter into a legally binding agreement with us and agree to these Terms of Use ("Terms").

Who can use OutThere

Downloading the OutThere app and accessing or using the Service is completely free of charge. There are no fees or subscription charges required to access standard app functionalities.

You must be 18 years of age or older to register for or use OutThere and have full legal capacity to enter into these Terms. By creating an account, you represent and warrant that you are 18 years of age or older. You may maintain only one active account, and all information provided during registration and profile creation must be accurate, true, and complete. You may not use the Service if you have previously been removed or permanently banned from OutThere for violations of our Terms.

Scope of Service

OutThere is strictly an event based social discovery tool designed to facilitate public group chats and direct messages among attendees interested in specific events during Amsterdam Dance Event (ADE).

We do not warrant, represent, or guarantee that you will chat with any other users, or that any attendees will be present in any event chat at any given time.

We do not perform criminal background checks, verify personal statements, or validate the identity of our users. You agree to exercise caution, common sense, and appropriate safety precautions in all interactions, especially if you choose to communicate off the Service, share contact details, or meet in person.

Recommendations

With your optional matching consent, OutThere recommends events and people using your selected interests, favourite artists and saved or going events. People matches require both people to opt in. You can change your taste and filters or turn matching off in Profile → Privacy choices. AI-assisted Ask search has a separate consent choice; search uses programme data and simple rules when it is off. The Privacy Policy explains the main ranking factors and controls.

Digital Services Act (DSA) Compliance & Content Rules

In compliance with Article 14 of the DSA, this section details the restrictions, rules, and moderation policies governing content on OutThere.

There is zero tolerance on OutThere for objectionable illegal, or abusive content and behaviour. You agree not to post, transmit, store, or share content or engage in conduct that

Moderation, Reporting, and Account Enforcement

To maintain platform integrity and safety, OutThere employs automated technology and human moderation.

Text content (such as chat messages) and images (including uploaded ticket images) are automatically screened prior to delivery or processing. High-risk violations (such as severe threats, CSAM, illegal content) are blocked automatically prior to delivery.

We utilise third-party AI service providers (including OpenAI) to read ticket details and check basic ticket format and process moderation inputs. Uploaded ticket images are held by our third-party provider in a secure, isolated environment for up to 30 days solely for safety, security, and abuse monitoring purposes before permanent deletion.

Complex moderation decisions, final account suspensions, permanent bans, and appeal reviews are conducted strictly by the human content moderation team.

Any user or third party can submit a notice regarding illegal content or breaches of our Terms directly within the app (via profile or chat report features) or by emailing customerservices@hostelworld.com.

Submitting false, malicious, or bad-faith reports is strictly prohibited and may result in account suspension.

Where content or conduct violates these Terms, we may apply any of the following measures:

If a restriction is imposed, we will provide the affected user with a Statement of Reasons detailing the specific restriction, the facts relied upon, whether automated tools were used, and the legal or contractual grounds (in accordance with the requirements under Article 17 of the Digital Services Act).

If you disagree with a moderation decision, such as the removal of content, suspension, or termination of your account, you have access to the following redress options:

Ticket Check Disclaimer (No Authentication)

OutThere offers an automated ticket format scanning feature. This feature checks solely whether an uploaded image visually resembles a typical event ticket layout.

The ticket check feature DOES NOT perform any technical, cryptographic, or official authentication checks. It does not scan, validate, or verify barcodes, QR codes, ticket serial numbers, or passholder identities against official ticketing databases, box offices, or event venues.

A "verified" label or check status within the app indicates only that the uploaded image appeared consistent with a basic ticket format at the time of check. Hostelworld gives no warranty or guarantee that any ticket checked via the app is genuine, valid, transferable, or will grant entry to any event or venue. OutThere does not sell tickets.

Your content

You retain all ownership rights in the text, photos, and media you post on OutThere ("User Content"). By posting User Content, you grant Hostelworld a non-exclusive, royalty-free, sublicensable, worldwide license to host, store, display, reproduce, and adapt your content solely for the operational purpose of running, delivering, securing, and promoting the Service.

This license terminates automatically when your content or account is deleted from our active systems.

All trademarks, logos, design elements, software, database compilations, and interface elements associated with OutThere are the exclusive property of Hostelworld.com Limited or its licensors. You may not scrape, frame, decompile, reverse engineer, or commercially exploit any part of the Service without our prior written authorisation.

OutThere is an independent platform operated by Hostelworld.com Limited. OutThere is not affiliated, associated, authorised, endorsed by, or in any way officially connected with the Amsterdam Dance Event Foundation (ADE) or any of its subsidiaries or affiliates.

If you believe content hosted on OutThere infringes your copyright, send a notice of infringement to corporate@hostelworld.com containing details of the copyrighted work, the infringing URL/location, and your contact information.

Account Closure and Data Retention

You can terminate your account at any time directly within the app via Profile → Delete Account

Upon voluntary account closure, your profile, photos, connection requests and direct chats are removed from active databases. Group messages remain disconnected from your profile until their rolling 60-day retention expires. Restricted reported content remains for its separate safety retention period, as explained in the Privacy Policy.

In accordance with our Privacy Notice and legitimate platform safety interests (Art. 6(1)(f) GDPR), reported content is retained for up to 12 months solely to enforce platform bans, handle legal disputes, and fulfil statutory obligations.

Limitation of Liability

To the maximum extent permitted by applicable law, OutThere is provided on an "AS IS" and "AS AVAILABLE" basis. Hostelworld makes no representations or warranties of any kind, express or implied, regarding the operation, availability, security, or reliability of the platform or any chat features.

To the fullest extent permitted by applicable law, in no event will Hostelworld, its parent company, affiliates, officers, directors, employees, agents, licensors, or service providers be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or other intangible losses, resulting from:

(a) your access to, use of, or inability to access or use OutThere;

(b) the conduct, content, or communications of other users or third parties on or off the platform; or

(c) unauthorised access, use, or alteration of your content or transmissions.

To the extent permitted under applicable law, Hostelworld’s aggregate liability to you for all claims arising out of or relating to your use of or inability to use OutThere shall be limited to the amount paid by you, if any, to Hostelworld for accessing OutThere during the twelve (12) months preceding the claim, or €100 (one hundred Euros), whichever is greater.

Nothing in these Terms shall limit or exclude Hostelworld’s liability for:

(a) death or personal injury caused by our negligence;

(b) fraud or fraudulent misrepresentation; or

(c) any other liability that cannot be excluded or limited under applicable EU, UK, or local statutory consumer rights legislation.

Hostelworld is not responsible for the online or offline conduct of any user of the OutThere platform. You are solely responsible for your interactions with other users. Hostelworld does not conduct criminal background checks or verify the identity or statements of its users.

You agree to exercise caution, common sense, and safety precautions in all interactions with other users, particularly if you choose to communicate off the OutThere platform, share contact details, or meet in person.

User Indemnification

To the extent permitted under applicable law, you agree to be responsible for any losses, liabilities, claims, or legal expenses incurred by Hostelworld arising directly out of your deliberate violation of these Terms, illegal conduct, or intentional infringement of third-party rights.

Law

These Terms are governed by and construed in accordance with the laws of Ireland. If you are a consumer residing in the European Union, you will benefit from any mandatory provisions of the law of the country in which you reside. Nothing in these Terms affects your rights as a consumer to rely on such mandatory local law provisions. Any dispute or claim arising out of or in connection with these Terms shall be subject to the jurisdiction of the courts of Ireland, provided that if you are an EU consumer, you may also bring legal proceedings in the competent courts of your country of residence.

If any provision of these Terms is held invalid or unenforceable by an administrative body or court of competent jurisdiction, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect.

These Terms constitute the entire agreement between you and Hostelworld regarding OutThere.

Changes to the Service and these Terms

We reserve the right to modify, suspend, or discontinue features of the Service for technical, operational, or safety reasons. Where a material change adversely impacts your access, we will provide reasonable advance notice where feasible.

We will notify you at least 15 days in advance of any significant or material changes to these Terms via an in-app notice or posting the updated terms on the app, in accordance with Digital Service Act transparency requirements. Your continued use of the Service after the effective date of updated Terms constitutes acceptance.
